“We operate in an increasingly litigious environment. This just seems to get worse and worse, for a whole variety of reasons.

I explored the route of employing a large employment services group on a retainer basis. On the face of it the benefits are huge-24/7 helpline, unlimited legal cover and at the end of it, an indemnity against any award one may incur at an Employment Tribunal. Although these companies are very expensive, it seemed like a cheaper option than constantly incurring ad hoc legal costs.

We decided not to pursue this route, however, for several reasons. As well as the inability to offer one point of contact, the terms one must follow to ensure eligibility for continued cover are very strict: in simple terms –unless you do exactly what they say, 100% of the time, then the liability cover becomes invalid. And a lot of the initial advice is utterly impractical. We would end up with half of our workforce on suspension (with full pay) at any one time….!
